HOTEL PARTIZÁN****, operated by the company HOTEL PARTIZÁN PS, s. r. o., - provider of accommodation, dining, conference, sport, and wellness services (hereinafter also referred to as "hotel") to the purchaser (guest) for a fee.
1 General Terms
1.2 These "General Contractual Conditions" govern the use of accommodation facilities and services provided by the Service Provider.
1.2 Special, individually agreed conditions do not form part of the published "General Contractual Conditions", however, the "General Contractual Conditions" do not exclude the conclusion of specific contracts and agreements with travel agencies, travel organizers, or with individual persons, which will take into account different and varied conditions as required by the particular case.
2 Service Reservation
2.1 The reservation can be made by the orderer either under their own name or on behalf of a third party.
2.2 The hotel confirms the reservation to the purchaser (guest) upon receiving the order from the guest in the form:
- by phone
- in writing
- electronically
2.3 The order must contain:
- name and surname of the guest or the company name
- date of hotel services usage
- contact details: telephone number, address of the guest, email contact
- method of payment for services, in case of a company billing details
- scope and type of ordered services
2.4 The hotel is required to process the order within 24 hours or on the next business day for group reservations by either confirming the reservation or rejection.
2.5 Based on the order, the hotel will issue a reservation confirmation, affirming the scope of services in writing or electronically to the guest.
3 Prices and Payment Conditions
3.1 The hotel provides the guest with prices based on the current price lists valid at the time of providing services. Unless a special price has been agreed in the contract, the purchaser is obligated to pay the price mentioned in the price list of the purchaser valid at the time of providing services.
3.2 Agreed prices are final and include value-added tax. If the period between the reservation of services and their provision exceeds 3 months and the supplier increases prices for the services ordered, the supplier may unilaterally increase the agreed price, but by no more than 5% of the total price of the agreed services.
3.3 The purchaser has no right to a price reduction if a promotional price for accommodation is published after the reservation is confirmed.
3.4 Discounts and promotions cannot be combined or accumulated.
3.5 On the day of departure, the guest is required to pay all the services utilized at the hotel and accommodation at the reception either in cash or by credit card.
3.6 The method of payment must be agreed upon in advance.
3.7 Any agreements that are broader than those adjusted in these General Contractual Conditions must be preliminarily approved by the company director and confirmed in writing by both parties in a separate Framework Agreement.
3.8 Reservation guarantee created via phone, in-person or email:
The hotel has the right to request from the guest an advance payment of 50% of the price of the ordered services due 7 days from the reservation confirmation. The reservation becomes binding at the moment the advance payment is paid to the hotel's account and confirmed by the supplier. In the case of reservations made 3 days before arriving or later, the guarantee of the reservation is the submission of the credit card details - card number, cardholder's name, and validity. In the case of reservations made 3 days before the stay, the reservation is guaranteed by withdrawing 50% of the advance payment from the credit card to the hotel account.
3.9 Online reservation guarantee:
In the case of a reservation guarantee by credit card, a 50% deposit will be withdrawn from the cardholder's credit card on the day of the reservation. In the case of a reservation guarantee through the Pay Pal system, the client will make a 50% deposit for the stay through this system on the day of reservation.
4 Advanced Payment for Groups and Events
4.1 The supplier issues an advance invoice from the estimated and agreed-upon price for all accommodation, dining, and additional services according to the order, with a due date 7 days from the day the advance invoice is issued as follows:
- 80% of the ordered services as confirmation of the reservation
- 100% for international purchasers
- 3 days before the usage of services, an advance payment amounting to 80% of the total ordered services must be paid into the supplier's account
4.2 The latest on the day of arrival, the ordered services must be paid.
4.3 The moment the advance payment is credited to the supplier's account held in Slovenská sporiteľna, a. s. acc. no.: SK48 0900 0000 0052 1062 9619, the order is confirmed by the supplier. From the time the order is received by the purchaser until the due date of the advance invoice, the service term is considered reserved. The paid advance will be settled in a regular tax document (invoice) after the stay is completed. If the purchaser duly and timely fails to pay the advance invoice, the supplier is entitled to cancel the reservation.
4.4 The advance payment can be made as follows:
- in cash or by credit card at the hotel reception
- by transfer to the account: Slovenská sporiteľna, a. s. acc. no.: SK48 0900 0000 0052 1062 9619 use the reservation number as the variable symbol • online by credit card
5 Cancellation Policy for Individual Reservations
The hotel is entitled to charge cancellation fees if the guest cancels their reservation in writing, by phone, or electronically during the following periods:
- from 14 to 7 days before the agreed date 50% of the total amount of reserved services,
- from 7 days to the day of arrival 100% of the total amount of reserved services,
- for early departure from the stay the hotel charges 100% of the confirmed remaining stay,
- for Christmas, New Year's Eve, and Easter stays, a 100% cancellation fee applies for reservations
canceled 21 days or less before the confirmed arrival date.
6 Cancellation Policy for Group Reservations
6.1 All order cancellations must be in written form and must be provably and clearly dated. The service provider charges the following contractual penalties for partial or full cancellation of services ordered by the purchaser:
Reserved capacity more than 30 rooms:
- 45 to 30 days before arrival is a cancellation fee of 60% of the confirmed services
- 29 to 10 days before arrival is a cancellation fee of 80% of the confirmed services
- 9 to 1 day before arrival is a cancellation fee of 100% of the confirmed services
6.2 In case of early departure or non-usage of ordered services, the purchaser pays the supplier the full amount of the price of all ordered services (including unused ones) except for cases where early departure or non-utilization of services was caused by non-provision of these services by the service provider.
6.3 The purchaser and the service provider have agreed on dates when the required accommodation capacity can be specified and when it is possible to unilaterally reduce it by the service provider or purchaser.
6.4 Conditions for the return of the deposit
In case of cancellation of the stay in accordance with valid cancellation conditions, the deposit will be returned within 60 days from the confirmation of cancellation by the hotel.
7 Accommodation Conditions
7.1 Only a guest who is registered for accommodation may be accommodated at the hotel. For this purpose, they must present their identity card or valid passport. They check and sign the registration card which they hand over to the receptionist when registering. Check-in is after 14.00.
7.2 The guest guarantees payment for reserved services (according to the number of nights) before authorization from the credit card or payment in cash during check-in. If the guest refuses to guarantee the reserved services, unfortunately, they cannot be accommodated. When utilizing room account services, the guest is required to present the hotel pass and sign the bill. The final bill is paid by the guest at the reception desk at the end of the stay.
7.3 Reception staff are authorized to request a partial payment of the bill whenever the balance of services utilized by the guest exceeds 500 EUR. For the continuation of the stay, we recommend our guests to pay the amount for the services utilized.
7.4 The room is reserved for the guest until 18.00 unless otherwise stated on the order. Rooms reserved, which the client has not moved into by 18:00 on the day of arrival, may be assigned to another guest. This does not apply if a later time of arrival was expressly agreed upon.
7.5 In special cases, the hotel may offer the guest other than the original accommodations if they do not differ significantly from the confirmed order. 7.7 A guest who is accommodated before 06:00 in the morning will pay the price for accommodation for the entire previous night.
7.8 If the accommodation period was not agreed upon otherwise, the guest will end their stay by no later than 10:00. If they do not do so by 16:00, the hotel has the right to charge an amount equivalent to 50% of the room price. After 16:00, the hotel may charge the full room price. Room cards must be handed in by the guest at the hotel reception along with the minibar consumption slip. In case of loss of the room card, the supplier is entitled to charge the guest an amount of 5 EUR per card.
7.9 If the guest requests an extension of the stay, they may be offered a different hotel room than the one they were originally accommodated in.
7.10 If the stay is ended prematurely as indicated by the departure day on the hotel pass, the guest is required to pay the room price for the next canceled day.
7.11 In the hotel room and in the hotel's communal areas, it is not permitted to make changes to the facilities, use own electrical devices (except for a shaver and hair dryer), bring into the room and communal areas of the hotel sports equipment and objects for which a different place is reserved.
7.12 From 22:00 to 7:00, the guest is required to observe night peace.
7.13 For security reasons, it is not allowed to leave children in the hotel room unattended.
7.14 Children up to 6 years old may only move around the hotel's communal areas if accompanied by an adult.
7.15 Children up to 15 years old may use the services of Family saunas in the Nature Wellness Center during opening hours. Children up to 15 years old are not allowed to enter the Vital & Sauna part of the Nature Wellness Center.
7.16 Children up to 15 years old may use the services of the Limbus entertainment center until 21:00.
7.17 The guest is required to properly inspect the room upon moving in and immediately report any deficiencies, faults, or reservations to hotel employees. The guest must proceed in the same manner if they notice any damage to the room or its inventory.
7.18 The guest is required to hand over the room with all its equipment unimpaired at the end of their stay (the inventory list is located in the room - in the closet). If the hotel notes damage to the room or its inventory after it has been handed over by the guest, the guest is required to compensate for the damage.
7.19 The guest is fully liable for damages caused to the hotel property.
7.20 All areas of the hotel – rooms, balconies, communal areas are non-smoking. It is prohibited to smoke cigarettes, cigars, and electronic cigarettes in these areas. In case of non-compliance, a fee for violating the ban in the amount of 200 € will be charged to the guest. The exception is the Cognac, rum & cigar club, where smoking cigars is allowed.
7.21 For hygienic and safety reasons, pets are not accepted in the hotel premises. Thank you for your understanding.
7.22 Found items are sent only upon request, and are stored at the hotel for 14 days from their discovery. After this period, the hotel is entitled to dispose of the found items.
8 Organized Events
8.1 The event is considered to be a social event attended by a larger number of people associated with providing various types of services (mainly accommodation, dining, wellness, and conference services). Unless agreed otherwise, it is understood that the purchaser (orderer of the event) is its organizer.
8.2 If the number of event participants deviates by more than 5%, the supplier is entitled to change the price for services or even exchange the confirmed rooms. The predetermined standard and technical equipment of the rooms, however, must remain preserved.
8.3 The purchaser has no legal claim to increase the scope of agreed services. In the case of a request from the purchaser to increase the scope of agreed services, the supplier may provide the purchaser with an increase in the scope of services at its discretion after evaluating the capacity possibilities of the hotel.
8.4 For events lasting longer than until 02:00, the supplier is authorized to require the purchaser from 02:00 to pay an extra charge for the service based on the services or goods provided if the agreed fee does not already consider a duration longer than until 02:00.
8.5 The purchaser is fundamentally not allowed to bring food or drinks to the events. Exceptions require prior written agreement by the supplier. In such cases, the supplier is entitled to require the purchaser to pay a service charge.
8.6 The purchaser is responsible for the payment of additionally ordered meals and drinks by the participants of their event.
8.7 At the event, the purchaser must not violate the copyrights of third parties, especially they are obliged to fulfill all obligations according to the legal regulations governing the use of copyrighted works effective and efficient on the territory of the Slovak Republic against organizations for copyright protection and other third parties who hold the relevant copyrights. The purchaser is fully liable for any infringement of intellectual property rights.
8.8 The purchaser is obliged to notify the supplier without invitation if the event is likely to disturb public order and limit or endanger the operation of the hotel, the interests, and good name of the supplier, the hotel, or hotel guests. The supplier is authorized to implement measures to prevent such a state, and the purchaser is required to endure them.
8.9 Any advertisements in print and electronic media, advertising, advertising campaigns, and announcements promoting events aimed at the general public, especially information about political, religious, and commercial events indicating the relationship to the hotel or supplier, require prior written consent from the supplier.
8.10 If the supplier arranges technical and other equipment from third parties at the instigation of the purchaser, it acts in the name, by full power, and on behalf of the purchaser. Rights and obligations towards these third parties regarding this equipment arise directly to the purchaser.
8.11 Using the purchaser's own electrical devices when using electrical or other cable networks of the hotel requires prior written consent from the company supplier. The supplier reserves the right to charge separately for such machines and devices that increase the costs of media delivery or hotel operation. If the use of these devices causes malfunctions or damage to the technical equipment of the hotel, the purchaser is required to compensate the supplier for costs associated with returning them to their original state. The supplier reserves the right to carry out checks on these devices through its employees or third parties and to take measures to prevent such a state, and the purchaser is required to endure these measures.
8.12 The purchaser is responsible for the safe technical condition of the equipment used during the usage of the hotel premises. The purchaser undertakes that only machines, devices, and equipment (appliances) that have a certificate or proven conformity according to legal regulations valid and effective in the territory of the Slovak Republic, which apply to them, will be used in these premises, whether directly by him or by individual event participants.
8.13 Brought decorative material and objects must comply with the statutory fire safety requirements. The supplier is authorized to request a statement from the relevant public administration authorities regarding compliance with the conditions required by legal regulations valid and effective in the territory of the Slovak Republic regulating fire safety. In the interest of preventing potential damage, the purchaser is required to arrange the installation and placement of objects in advance with the supplier.
8.14 Brought exhibition and other items must be removed immediately after the event by the purchaser. In case of neglect of this obligation, the supplier is entitled to charge rent for the duration of the items' presence in the hotel. The supplier is also entitled to perform their removal and storage at the purchaser's expense without thereby creating a contract for storage or
